Sharper Marketing LLC provides AI tool implementation, marketing automation, SMS/text marketing, and related digital marketing services for small businesses. Specific service details, deliverables, and timelines are defined in individual service agreements.
3. SMS/Text Messaging Terms
This section governs the use of SMS/text messaging services provided by Sharper Marketing LLC in compliance with the Telephone Consumer Protection Act (TCPA), Cellular Telecommunications Industry Association (CTIA) guidelines, and A2P 10DLC registration requirements.
3.1 Consent to Receive Messages
By providing your mobile phone number and opting in to our messaging program, you expressly consent to receive recurring automated marketing and informational text messages from Sharper Marketing LLC, including but not limited to:
- Promotional offers and marketing messages
- Appointment reminders and confirmations
- Service updates and notifications
- Follow-up communications related to your inquiries
Consent is not a condition of purchase. You are not required to opt in to SMS messaging to purchase any goods or services from Sharper Marketing LLC.
3.2 Message Frequency & Rates
Message frequency varies. You may receive up to 10 marketing messages per month, plus additional transactional messages. Message and data rates may apply. Your mobile carrier's standard messaging rates will apply to all text messages sent and received. Contact your carrier for pricing details.
3.3 Opt-Out Procedures
You may opt out of SMS messages at any time using any of the following methods:
- Reply STOP to any message you receive from us to immediately opt out
- Reply HELP to any message for assistance and support information

After opting out, you will receive one final confirmation message. You will not receive any additional messages unless you re-opt-in. You may re-opt-in at any time by texting START or by contacting us.
3.4 TCPA Compliance
Sharper Marketing LLC complies with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state regulations regarding text messaging. We maintain records of all opt-in consents and process opt-out requests promptly. We do not send text messages to numbers on the National Do Not Call Registry without prior express written consent.
3.5 CTIA Compliance
Our SMS program adheres to CTIA Short Code Monitoring Handbook guidelines and CTIA Messaging Principles and Best Practices, including:
- Clear disclosure of messaging program terms at the point of opt-in
- Honoring all opt-out requests immediately
- Providing HELP functionality for program assistance
- Including required disclosures in all opt-in flows
- Maintaining proper records of consent
3.6 Carrier Disclaimer
Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your mobile carrier. T-Mobile, AT&T, Verizon, and other carriers are not responsible for the content of messages sent through our program. Service may not be available in all areas or on all carriers.
3.7 Supported Carriers
Our SMS service is compatible with most major U.S. carriers, including but not limited to AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, and their MVNOs. Service availability may vary.
4. Intellectual Property
All content on this website, including text, graphics, logos, and software, is the property of Sharper Marketing LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
5. User Responsibilities
When using our services, you agree to:

- Not use our services for any illegal or unauthorized purpose
- Not attempt to interfere with the operation of our website or services

6. Limitation of Liability

Our total liability shall not exceed the amount paid by you for services in the preceding twelve (12) months.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or secure. Results from AI tool implementations may vary based on individual business circumstances.
8. Indemnification
You agree to indemnify and hold harmless Sharper Marketing LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses arising from your use of our services or violation of these terms.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Washington County, Utah.
10. Changes to Terms
